Terms of Service – Cloud Content Group

Please read these Terms of Service (“Terms”) carefully. By accessing or using the services provided by Cloud Content Group (“Service”, “we”, “us”, “our”), you agree to be bound by these Terms.

1. The Service

Cloud Content Group provides an AI-powered platform for generating visual content. We provide the technology (models such as Nano Banana / Pro) and the infrastructure. Our service is a tool; the creative output depends on your inputs.

2. User Responsibility & Content Rights

You bear the sole and exclusive responsibility for all data, images, and prompts you upload or generate through our platform (“User Content”).

  • Third-Party Rights: You warrant that you hold all necessary rights (copyrights, trademarks, personality rights) for the product photos and reference images (e.g., models) you upload.
  • Indemnification: You agree to indemnify and hold Cloud Content Group harmless from any and all third-party claims arising from a violation of these rights or any illegal use of the generated content.
  • Model Releases: If you upload images of real persons (models), you guarantee that valid consent (Model Release) for AI-supported processing and commercial use has been obtained.

3. Usage Restrictions

You represent and warrant that you will not use the Service to:

  • Generate discriminatory, hateful, violent, pornographic, or otherwise illegal content.
  • Create “deepfakes” or content intended to deceive others regarding the identity of individuals.
  • Interfere with the stability of our systems through automated queries (scraping) or other unreasonable loads.

4. Ownership and Licenses

  • Your Inputs: You retain all rights to your original uploaded images.
  • Generated Outputs: Cloud Content Group claims no ownership of the images generated by you. However, the risk regarding the copyrightability and commercial protectability of AI-generated images rests solely with you.
  • Processing License: You grant us the technically necessary, worldwide license to store and process your content to provide the Service (e.g., hosting on Google Cloud).

5. Credits and Payments

  • The Service operates on a credit basis. Credits are purchased via Stripe.
  • No Refunds: Purchased credits are non-refundable and cannot be exchanged for cash.
  • Failed Generations: Our system is designed to automatically refund credits for technical generation failures. No further claims exist beyond this automated refund.

6. Disclaimer of Warranty (As-Is)

The Service is provided on an “as-is” and “as-available” basis. We do not guarantee that the results will meet your expectations, that the service will be uninterrupted, or that the generated images are free of third-party rights. AI can produce unpredictable or flawed results.

7. Limitation of Liability

To the maximum extent permitted by law, Cloud Content Group shall only be liable for intent and gross negligence. Liability for indirect damages or lost profits is excluded.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, if you violate these Terms.

9. Changes to Terms

We may update our Terms from time to time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Services after the changes become effective constitutes your acceptance of the new Terms.
